
According to a recent post on his web site, Mister Phillips, an announced candidate for Contra Costa Supervisor District I, asked the Office of the Clerk of the Board of Supervisors (BOS) to give Phillips incumbent John Gioia’s voting record.
According to Phillips,”The Office claims not to record the individual votes of county supervisors. However, California Government Code Section 25101(b) states: “The vote of each member on every question shall be recorded.” So why will the Office not show me the votes? Does Mr. Gioia have something to hide? If not, he should let the Office give me a certified copy of his complete voting record.”
Parsing government code aside, it may just not be possible, according to Julie Enea. Enea is acting clerk of the Board of Supervisors as Jane Pennington, who originally interacted with Phillips, has left County service since.
“We do record every vote but there is no document that compiles the individual voting records,” said Enea. “There is no business reason to keep such a document and no way to automate such a task easily.”
Enea insists that every board decision is recorded in the source documents including annotated minutes that either mark votes 5-0 or “approved as recommended” for Consent Calendar items. But these have been available only online since February, 2009. It was only 2005 when the county began making videos of BOS available online, she noted.
Enea says that the Clerk’s office of the BOS is happy to research voting records by topic.
