Assemblyman Guy Houston’s (R-San Ramon) legislation aimed at preventing online harassment passed the Assembly floor yesterday and has been sent to the governor for his signature. Assembly Bill 919, the Internet Stalking Bill, is designed to protect citizens from stalking, harassment and other abuse over the internet. This legislation borders on censorship and overlooks the camel nose under the tent of Internet regulation. Amazing to see so-called conservatives trash rights in the name of big government enforcement of bourgeois morality just because parents can’t supervise their kids’ online accounts.
The measure came about after a 17-year-old Danville girl was harassed when her picture and cell phone number was taken from her MySpace page, and posted on Craigslist with a lewd advertisement. The dozens of phone calls she received were obscene and threatening yet, police were unable to prosecute because it was not against the law.
Please tell me how the legislature thinks it’s going to enforce this. How are they going to indict the Russian Mafia in Chechnya for posting cheesecake from My Space on Craigslist? What are they going to do, send Senator DeSaulnier over to Grozny to tell hem bad jokes until they beg, “OK Komrade, stop and we will let you extradite us!” Instead, any parent that lets their idiot teen age girl publish pretty pictures AND HER PHONE NUMBER!!! on the Internet should be fined for being stupid, pandering, and contributing to the delinquency of a minor.

There is no law that can stop bad people around the world from taking advantage of stupid people, especially minors and their idiot parents, that publish their picture and phone number on the Internet.
All this Rah Rah Mom and Apple Pie legislation does is open up the door of letting bureaucrats and government whim decide what “harassment” means.

The government should stay out of media regulation.
The United States must not imitate China. Internet users in China get nowhere when they type in words like “Tibet.”
If government gets involved in the Internet, there consequences are likely to be government control of what is published and taxation of Internet services.
